Terms & Conditions​
1. Scope of Work
All work will be completed substantially as outlined in the approved quote, proposal, estimate, or contract documents. Any modifications, additions, or changes requested by the Customer after approval must be authorized in writing and may result in additional charges, schedule adjustments, or both.
2. Payment Terms
A deposit of fifty percent (50%) of the total project cost is due upon contract approval unless otherwise specified in writing. The remaining balance is due immediately upon substantial completion of the work. Failure to remit payment when due may result in finance charges, collection costs, attorney fees, and/or mechanic’s lien rights as permitted by law.
3. Permit Handling and Fees
Dutch Valley Roofing will coordinate and manage the permitting process on behalf of the Customer when permits are required. A non-refundable permit administration fee of
$1,000.00 will be added to the project total to cover permit application preparation, administrative time, inspections, and permit-related expenses.
The Customer agrees to cooperate with all permit requirements, including signing documents, providing access for inspections, and complying with local municipal requirements. Dutch Valley Roofing shall not be responsible for delays caused by permit processing times, inspection scheduling, or municipal actions outside of Dutch Valley Roofing’s control.
4. Hidden Conditions / Unforeseen Structural Issues
Quotes are based on visible and reasonably accessible conditions at the time of inspection. Dutch Valley Roofing shall not be responsible for concealed, hidden, or pre-existing conditions including, but not limited to, rot, mold, water damage, insect damage, structural deficiencies, improper prior construction, code violations, deteriorated framing, or subsurface conditions discovered during construction. Any corrective work required will be treated as additional work and billed accordingly.
5. Project Delays and Force Majeure
Dutch Valley Roofing shall not be held liable for delays or inability to perform caused by weather, unsafe working conditions, material shortages, supplier delays, labor shortages, acts of God, governmental actions, utility interruptions, inspection delays, or other events beyond Dutch Valley Roofing’s reasonable control. Project timelines are estimates only and are subject to change.
6. Customer Responsibilities
The Customer is responsible for providing safe and reasonable access to the property, driveway, electrical service, and work areas during the project. The Customer agrees to remove or protect vehicles, furniture, decorations, landscaping items, pets, and personal belongings from the work area.
While reasonable care will be taken, Dutch Valley Roofing shall not be responsible for damage to concealed utilities, underground systems, irrigation lines, landscaping adjacent to work areas, or items not removed from active construction zones.
7. Roofing, Siding, Decking, Gutter, and Exterior Construction Risks
Exterior construction projects may involve vibration, debris, noise, dust, and temporary exposure of structures to weather conditions during active work. The Customer acknowledges that minor cosmetic disturbances may occur to landscaping, lawns, siding, drywall, paint, ceilings, driveways, or adjacent surfaces as a normal result of construction activities.
8. Warranty
Dutch Valley Roofing provides a limited workmanship warranty for a period of six (6) months from the date of substantial completion covering defects in workmanship and structural installation issues directly resulting from Dutch Valley Roofing’s labor.
This warranty does not cover:
- Damage caused by homeowner negligence, abuse, misuse, modification, or lack of maintenance;
- Damage caused by storms, hail, wind, flooding, falling objects, acts of God, or other external causes;
- Normal wear and tear;
- Pre-existing structural deficiencies or hidden conditions;
- Material manufacturer defects covered under separate manufacturer warranties;
- Damage caused by third parties or other contractors;
- Movement, settling, or shifting of existing
9. Warranty claims
Warranty claims must be submitted in writing within the warranty Dutch Valley Roofing reserves the right to inspect and determine the appropriate repair method.
10. Manufacturer Warranties
Manufacturer warranties, when applicable, are separate from Dutch Valley Roofing’s workmanship warranty and are subject to the manufacturer’s terms, exclusions, and limitations. Dutch Valley Roofing does not independently guarantee manufacturer products or materials.
11. Cancellation Policy
Customer may cancel this agreement within seventy-two (72) hours of signing unless materials have already been ordered, permits submitted, or work commenced. Any cancellation after this period may result in forfeiture of deposits, permit fees, administrative costs, material costs, and any labor or scheduling expenses incurred by Dutch Valley Roofing.
12. Right to Stop Work
Dutch Valley Roofing reserves the right to suspend or terminate work for non-payment, unsafe conditions, customer interference, denied site access, or breach of contract terms.
13. Photographs and Documentation
Dutch Valley Roofing may photograph the project site before, during, and after completion for documentation, warranty, insurance, permitting, and marketing purposes unless otherwise prohibited in writing by the Customer.
14. Limitation of Liability
To the fullest extent permitted by law, Dutch Valley Roofing’s liability for any claim arising from the project shall be limited to the amount paid by the Customer under this contract.
Under no circumstances shall Dutch Valley Roofing be liable for incidental, indirect, consequential, or punitive damages.
15. Entire Agreement
These Terms and Conditions, together with the approved quote or contract documents, constitute the entire agreement between the parties and supersede prior discussions or representations unless otherwise agreed to in writing.
16. Acceptance
Approval of the quote, payment of deposit, electronic acceptance, or signature constitutes acceptance of these Terms and Conditions.
